I'm ready to file for legal separation. I want to divorce, but I told hubby I'd do the legal separation (he wants neither, but accepts that I'm done). We will both stay in our house until the school year is over (so June 2016). My big fear is money. We've been married 21 years and I have never worked during our marriage. I do not have a college degree, either. Hubby makes decent money and I've seen what the child support and spousal support calculators say he'll need to pay each month and it's a decent amount. That doesn't mean that's what will be ordered. Yes, I'll need to downsize and probably get a part time job, but that's fine. Maybe I'll go back to school. There is also a 401k. Will I get half? What are the tax implications from splitting that? I think I can get by without using any of the 401k and just put it into my own retirement account. I will need to pay taxes on the spousal support, right? What if we still filed our taxes joint ly? I just want to be financially ready to leave when the time comes. I don't want to be figuring it out then. I'm in NM if that helps.
